These Terms & Conditions apply to orders placed with Natures Playground Limited, trading as Nature’s Playground.
1. About us
We are Natures Playground Limited, a company registered in England and Wales under company number 16943758.
Our registered office is:
Unit 2 The Old Dairy, Culverthorpe, Grantham, Lincolnshire, England, NG32 3NQ
You can contact us using:
Email: info@naturesplayground.uk
Telephone:07497 305555
Website: https://naturesplayground.uk/
In these Terms, “we”, “us” and “our” means Natures Playground Limited. “You” and “your” means the customer placing an order with us.
2. Who these Terms apply to
These Terms apply to all sales of products and related services by us, including orders placed through our website, by email, by telephone, by quotation or by invoice.
Our products are mainly designed for nurseries, schools, early years settings, outdoor learning environments and similar organisations, but these Terms also cover consumer orders where applicable.
If you place an order on behalf of a nursery, school, academy trust, local authority, business or other organisation, you confirm that you have authority to place that order and bind that organisation.
Where you are a consumer, nothing in these Terms affects your statutory rights.
3. Products and handmade timber items
We design, make and supply handmade wooden furniture, outdoor play equipment, learning resources and related products.
Because many of our products are handmade from natural timber, there may be natural variations in grain, colour, knots, texture, finish, tone and appearance. These natural variations are part of the character of the product and will not usually be treated as faults.
Wood is a natural material and may expand, contract, fade, silver, weather, develop surface checking, small splits or movement over time, especially when used outdoors. These changes are normal unless they affect the structural integrity or safety of the product.
Dimensions, finishes, images and colours shown on our website or in brochures are approximate unless we expressly confirm otherwise in writing.
We may make minor changes to a product’s design, construction, materials or finish where this does not materially reduce the quality, safety or intended use of the product.
4. Product suitability and supervision
Our products are intended for use in supervised nursery, school, early years, play or comparable environments.
You are responsible for making sure the products are suitable for your setting, age group, site conditions, layout, supervision arrangements and intended use.
Children must be appropriately supervised when using our products.
Unless we expressly agree installation or site assessment services in writing, you are responsible for safe positioning, fixing, installation, inspection and ongoing maintenance.
5. Orders and contract formation
Product listings, website content, brochures, quotations and estimates are invitations to place an order and do not create a binding contract by themselves.
A contract is formed only when we accept your order. This may happen when we issue an order confirmation, accept payment, confirm a quotation, issue an invoice, or otherwise clearly confirm acceptance in writing.
For bespoke, custom, made-to-order or project-based work, the quotation, specification, drawings, measurements, design notes, invoice and these Terms together form the agreement between us, unless we agree something different in writing.
You are responsible for checking all order details before confirming your order, including product choice, measurements, colours, finishes, delivery address, access information and any custom requirements.
6. Prices and payment
Prices are shown in pounds sterling.
VAT will be charged where applicable at the rate in force at the time of supply.
For website orders, payment is usually required at checkout.
For bespoke, large or project-based orders, we may require a deposit before design work, material ordering or manufacture begins. The balance will be due in line with the quotation or invoice.
If payment is overdue, we may pause design, manufacture, delivery, installation or further work until payment is received.
Ownership of goods passes to you only once we have received payment in full.
7. Bespoke, custom and made-to-order goods
Many of our products may be made, finished or adapted specifically for your order.
A product will be treated as bespoke, custom or made-to-order where it is made to your measurements, specifications, drawings, requested finish, requested colour, site requirements, personalisation or other individual instructions.
Once we have started design work, ordered materials, started manufacture or otherwise committed costs for a bespoke or made-to-order item, you may not cancel that item unless we agree otherwise in writing.
Bespoke, personalised, custom-sized, custom-finished, site-specific or made-to-order items are non-refundable unless they are faulty, misdescribed, not of satisfactory quality, not fit for a purpose made known to us, or we are otherwise required to provide a remedy by law.
8. Delivery
Our standard delivery lead time is usually 14 to 21 days, unless a different lead time is shown on the product page, quotation, invoice or order confirmation.
Lead times are estimates unless we have expressly agreed a fixed delivery date in writing.
Delivery to UK mainland is free on the purchase of three or more items, unless a different delivery arrangement is stated on the relevant product page, quotation or order confirmation.
For orders of fewer than three items, non-mainland delivery, remote-area delivery, pallet delivery, specialist delivery or large items, delivery charges may apply. These will be shown at checkout or confirmed before the order is accepted.
Unless otherwise agreed in writing, delivery is to the nearest reasonably accessible front-door, kerbside or ground-floor delivery point at the delivery address.
Delivery does not include unpacking, carrying items through a building, moving items upstairs, assembly, installation, fixing, removal of packaging or placement in a specific room or outdoor area unless we have expressly agreed this in writing.
You must make sure that:
- the delivery address is correct;
- there is safe and suitable access for the delivery vehicle;
- there is enough room for unloading;
- someone responsible is available to accept delivery;
- we are told in advance about access restrictions, narrow roads, steps, gravel, uneven ground, parking restrictions or other delivery issues.
If delivery fails because of incorrect information, unsuitable access, nobody being available, or circumstances within your control, we may charge reasonable redelivery, storage or additional handling costs.
If you are a consumer and no delivery date has been agreed, we will deliver without undue delay and no later than 30 days after the contract is formed, unless you agree otherwise.
9. Inspection on delivery
Please inspect your goods as soon as reasonably possible after delivery.
If any item appears damaged, incomplete or incorrect, please contact us promptly at info@naturesplayground.uk with your order number, photographs and details of the issue.
We ask that visible transit damage, missing items or delivery shortages are reported within 48 hours of delivery where possible. This helps us deal with couriers, carriers and insurers.
This 48-hour request does not remove any statutory rights you may have if goods are faulty, damaged, misdescribed or not legally compliant.
10. Consumer cancellation rights for standard goods
This section applies only where you are a consumer buying standard, non-bespoke goods by distance means, such as online, by phone or by email.
You have the right to cancel your order for standard, non-bespoke goods within 14 days after the day you receive the goods.
To cancel, you must tell us clearly before the cancellation period ends. You can email us at info@naturesplayground.uk.
After telling us you wish to cancel, you must send the goods back to us within 14 days.
Unless the goods are faulty, damaged, misdescribed or we agree otherwise, you are responsible for the direct cost of returning the goods.
We will refund the price paid for the returned goods and the basic outbound delivery charge, where applicable, within 14 days after we receive the goods back or receive evidence that you have sent them back, whichever is earlier.
We may reduce the refund to reflect any loss in value caused by handling beyond what would reasonably be allowed in a shop.
Consumer cancellation rights do not apply to goods made to your specifications, clearly personalised items, bespoke items or custom-made products. Your rights in relation to faulty, damaged or misdescribed goods are not affected.
11. Business and discretionary returns
This section applies to business customers and to returns that fall outside statutory consumer cancellation rights.
Standard, non-bespoke goods may be returned only where we agree in writing.
To request a return, you must contact us within 14 days of receipt.
Returned goods must be unused, complete, clean, in their original packaging where reasonably possible, and in resaleable condition.
Approved business or discretionary returns are subject to a 20% admin / restocking fee, plus the direct cost of return shipping.
We may refuse a return or make a larger reasonable deduction where goods are damaged, used, incomplete, altered, installed, weathered, marked or not in resaleable condition.
Bespoke, custom, personalised, made-to-order, custom-sized, custom-finished or site-specific items cannot be returned unless they are faulty, damaged, misdescribed or we are otherwise required to provide a remedy by law.
12. Faulty, damaged or misdescribed goods
Nothing in these Terms limits your legal rights where goods are faulty, not of satisfactory quality, not fit for purpose where that purpose was made known to us, not as described, incorrectly installed by us, or otherwise legally non-compliant.
If you believe an item is faulty, damaged or misdescribed, please contact us as soon as reasonably possible with your order number, photographs and a description of the issue.
Depending on the circumstances, we may offer repair, replacement, replacement parts, refund, price reduction or another appropriate remedy.
13. Installation services
Installation is included only where expressly stated in your quotation, invoice or order confirmation.
Where installation is not included, you are responsible for safe assembly, fixing, positioning and installation.
Where we provide installation, you must ensure that the site is safe, accessible, clear and ready for installation before we arrive.
You are responsible for telling us about underground services, drainage, pipes, cables, unstable ground, access issues, site restrictions or hazards before installation begins.
We may charge reasonable additional costs if installation is delayed or made more difficult because the site is not ready, access is unsuitable, or we were not told about relevant site conditions.
14. Ten-year limited timber guarantee
Unless a different guarantee period is stated on the relevant product page, quotation or order confirmation, our timber products are supplied with a 10-year limited guarantee from the date of delivery.
This guarantee covers structural failure caused by defects in workmanship or timber rot/decay under normal intended use.
This guarantee is valid only where the product has been:
- correctly installed, fixed and positioned;
- used only for its intended purpose;
- kept in suitable conditions with adequate drainage and ventilation;
- protected from avoidable standing water and prolonged ground saturation;
- properly weatherproofed, conditioned and maintained;
- cared for in line with any care instructions or product-specific guidance we provide.
Outdoor timber products must be weatherproofed, conditioned and maintained with suitable exterior-grade timber treatment, oil, preservative or protective finish appropriate to the product and its environment.
Unless we state otherwise in writing, outdoor timber products should be inspected regularly and re-treated as needed, and at least annually where exposed to outdoor conditions.
In harsher conditions, including unusually wet, shaded, coastal, high-UV, high-use or poorly drained locations, more frequent maintenance may be required.
We may ask for evidence of proper maintenance when assessing a guarantee claim. This may include photographs, dates of treatment, receipts for timber treatment products, maintenance logs or inspection records.
The guarantee does not cover:
- ordinary wear and tear;
- natural weathering, fading, greying or colour change;
- timber movement, checking, small splits, shrinkage or expansion that does not affect structural integrity;
- cosmetic marks, stains, surface mould or mildew caused by environmental conditions;
- damage caused by standing water, poor drainage, unsuitable ground conditions or prolonged saturation;
- damage caused by neglect, lack of maintenance or failure to weatherproof/condition the product;
- damage caused by misuse, overloading, impact, vandalism, abuse or accidental damage;
- unauthorised repairs, alterations, modifications or additions;
- damage caused by incorrect installation where we did not install the product;
- damage caused by extreme weather, flooding, storms or events outside normal use.
To make a guarantee claim, contact us at info@naturesplayground.uk with your proof of purchase, photographs, a description of the issue and evidence of maintenance.
If a valid guarantee claim is accepted, we may repair the item, replace the item, supply replacement parts, offer a price reduction or provide another appropriate remedy, depending on what is reasonable and proportionate.
This guarantee is given by Natures Playground Limited, company number 16943758, registered office Unit 2 The Old Dairy, Culverthorpe, Grantham, Lincolnshire, England, NG32 3NQ.
Unless otherwise stated, the guarantee applies within the United Kingdom only.
This guarantee is in addition to, and does not affect, any statutory rights a consumer may have.
15. Care and maintenance
You are responsible for regular inspection, care and maintenance after delivery or installation.
Outdoor timber products should be kept clean, allowed to dry naturally, positioned to avoid unnecessary standing water, and treated with suitable exterior timber protection.
You should check fixings, joints, surfaces, edges and structural parts regularly, especially in high-use nursery, school or early years environments.
If a product becomes unsafe, damaged, loose, unstable or excessively worn, you must stop using it until it has been repaired or replaced.
Failure to inspect, weatherproof, condition or maintain products properly may invalidate the 10-year limited guarantee.
16. Use of website
You must not misuse our website, attempt to interfere with its security, upload malicious code, scrape content without permission, or use the website unlawfully.
All content on our website, including text, images, product designs, photographs, graphics and branding, belongs to us or our licensors and must not be copied, reproduced or used without permission.
17. Liability
Nothing in these Terms excludes or limits liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation;
- breach of your statutory rights where you are a consumer;
- any other liability that cannot legally be excluded or limited.
If you are a consumer, we are responsible for foreseeable loss or damage caused by our breach of contract or failure to use reasonable care and skill, but we are not responsible for loss or damage that is not foreseeable.
If you are a business customer, and subject to the paragraph above, our total liability arising out of or in connection with your order shall not exceed the total amount paid for the goods or services giving rise to the claim.
If you are a business customer, we will not be liable for loss of profit, loss of revenue, loss of business, loss of contract, loss of goodwill, loss of anticipated savings, business interruption, or any indirect or consequential loss.
18. Events outside our control
We are not responsible for delay or failure caused by events outside our reasonable control, including severe weather, transport delays, supplier delays, material shortages, strikes, accidents, fire, flood, illness, power failure, internet failure, war, civil unrest, government restrictions or other events beyond our control.
If such an event affects your order, we will contact you as soon as reasonably possible and take reasonable steps to minimise the effect.
19. Complaints
If you have a complaint, please contact us at:
Email: info@naturesplayground.uk
Please include your order number, contact details, photographs where relevant, and a clear description of the issue.
We will aim to respond within a reasonable time.
20. Privacy
We process personal data in accordance with our Privacy Policy, which is available on our website.
21. Changes to these Terms
We may update these Terms from time to time.
The Terms that apply to your order will be the Terms in force at the time your order is accepted, unless we are required to make a change by law or regulation.
22. Governing law
These Terms are governed by the law of England and Wales.
If you are a consumer living in Scotland or Northern Ireland, you may also rely on any mandatory consumer protections available in your part of the United Kingdom.
23. Model cancellation form
You may use this form if you are a consumer and wish to cancel a standard, non-bespoke distance order.
